Maketh Oath he sevral times endea-
voured to serve the above prosecutor
with a notice of Fryal and that he
caused a Notice to be left on the Fifth
day of september instant at the house
of the prosecution in Queen anne Street
East
Saint Marylebone
and this deponent
saith he was advised, that by the G [..]
of this Honourable Court it is necessary
to serve the prosecutor personally which
he this deponent notwithtanding his
utmost exertions has not been able to do previous
to entering his venice without leave
first obtained by order of Court and
this Deponant further saith that this
application is not made for the
purpose of delay but entirely on
account of the reason above stated
