Indicted for a Fraud and
Misdemeanor

Edward Martin< no role > of Wapping wall in the Parish of Saint Paul Shadwell
in the County of Middlesex Butcher the Prosecutor of the Indictment against the said
Defendant maketh Oath that at the Session of the Peace held for the said County in
the Month of April last he this Deponent preferred an Indictment against the
Defendant William Newbald< no role > for unlawfully knowingly and designedly
by false pretences respecting the Acceptor of a Bill of Exchange obtaining from
this Deponent the Sum of fifty pounds five shillings and six pence with
intent to cheat and defraud this Deponent thereof against the form of the Statute
in such Case made and provided in pursuance of a Recognizance before
entered into before Mr. Staples one of the Justices of the Peace for the said County
and this Deponent saith that such Indictment were found by the Grand
Jury to be a true Bill but the said Deft who was under Recognizance with
Bail to appear at the same Session and answer such Crime postponed
taking his Trial at that Session and the said Defendant did also at the Session
of the Peace held in the Month of May last postpone taking his trial on the
said Indictment until this present Session and this Deponent saith that
Benjamin Steinmetz< no role > of Ratcliffe Highway in the said County Tallow Chandle
is a material and necessary Witness for this Deponent in the Prosecution of
the said Indictment against the said Defendant on his Trial as this
Deponent [..] is advised and verily believes and this Deponent saith
that he cannot safely proceed in the said Prosecution against the said
Defendant on his Trial on the said Indictment without the benefit of the
Testimony of the said Benjamin Steinmetz< no role > on such Trial as this Deponent is advised and verily believes And this Deponent
saith that Notice of Trial was given by the said Defendant on Wednesday
last and this Deponent caused a Subpeeana to be taken out in order to be
served
