for an Assault

William Wells< no role > of White Chaple Road in the Parish
of Saint Dunstan Stepney in the County aforesaid
Yeoman the above named Defendant Maketh Oath
and Saith that he caused the Prosecutor to be served
with a Copy of the Notice hereunto Annexed, and not
being Conversant in the Practise of this Court or
having advised with any person thereon, thought
he this Deponent could take out this Service this
Day & have his trial but on Enquiry is Informed
be can't get his Service without application to the
Court and further Deposeth that the [..] is ready
with his Witnesses, but it through his neglect in taking
out the Service, the trial Don't come on this Session
he may loose the benefit of seem [..] his Witnesses
testimony
