firstly make the
Oath and Saith that about three Weeks before Febry. Session he gave Charges
to one Douglas Nice< no role >

of the said Desr. for shall a He ass his property
which said Deft. was Conveyed before Mr. Justice Conant when he the said
Prosr. was from and upon his Testimony the Deft. was committed to New
Prison
for Trial at the ensuing. Session being Febry. Session 1786. and was
bound in a Recoged. to prosecuted the said Deft. by Mr. Justice Conant as aforesaid
And further upon his Oath Saith that at
the time he was so to appear at the said Session he was so Closely confined in Bed
Room for upward of a for might afterward. And further saith that had he
not been prevented by such illness, it is sole intention toapphave
appeared and prosecuted

Jointly and separately Maketh Oath and faith that they appeared
at the Court of Session in Febry 1786. in order to give Evidce. upon the
Indict (as any was preferred) when they were informed they need
not attend without the Prosx. (and if they did) as bill could be obtained
without the prosecutor's attendance, and being total strangers of the
Practice of the Court, which away in Conseqse. of such answer
And further upon this Oaths Saith
they were found in a Recog. before Mr. Justice and as aforesaid
to give Evidce. upon the said Indictr
. and that they had no other reason
or design of any sort whatever but to have given Evidce. had not the
have been so informed
