were present in Court on the sd 24th day of February 1783 this
Dept having on that day seen them all in Court & having on the
same day entered their Names in the first page of the said Session
Book of Febry 1783 and this Dept further Saith that william

Joseph Girdler< no role > & Jno Staples< no role > being ten of the Justices who were so
present in Court on the said 24th day of February 1783 are Justice
named in the said Common of Oyer & Terminer And this Dept
verily believes that nearly all the last mentd Justices it not all of
them were present in Court when the sd Indictment against the sd
Christr Atkinson was returned by the Grand Jury a true Bill
And this Deponent further saith that at the opening of the
sessions on the sd 24th day of febry 1783 the Grand Jury were called
& Sworn under both commons & their Names were immediately
afterwds entered by this Dept. in the sd Sessions Book of Febry
1783 & then marked as sworn under the Common of orpr & Terminer
And this Dept Saith that the Indictmt agt the sd Christr Atkinson< no role >
having been acturned by the sd Grand Jury as a true Bill was
immedy enterd in the rough Calenders of Indictmt & aftwds copied from thence into the sd February
Sessions Book And this Dept further saith that on or about the
25th day of the same Month of Febry 1783 his Majestys Writ of
Certiorari directed to the Justices of Oyer and Terminer for the county
of Middx for the Removal of all Indictments against the said Dept
into this Honble Court was to the best of this Depts remembrance
& belief brought by the Depts Sollr Mr Froward & some short
time before Easter Term 1783 he this Dept not having been before
used to that part of the Business the same being in the immediately
Department of the Senior Clerk who used to prepare the same for
the inspection of Mr Eyles through mistake as this Dept now find
took the printed form of a return used as a Return to Indictmt
found under the Common of the peace Instead of the form used
as a Return to Indictments found under the Common of Oyer
& Terminer, But this Dept knowing that the sd Indictmt was
found at the session of Oyer & Terminer and conceiving
that it should be so stated in the Return struck out the wood
"the peace" & Interlined the unds "Oyer & Terminer" wch Alternation
