Saith that he waited all the Afternoon in Court and every succeeding
Day of the Session till about Noon of the Saturday following to
know whether the Indictment was returned true or not and at
different Times paid three or four Sixpences for Searching but
was always informed by the Clerk that he had no Account of
any such Bill or that it was not in his list or to that Effect
And this Deponent William Bolton< no role >
further Saith that to his
great Surprize he received a Letter on Saturday last from the
Clerk of the Peace's Office informing him that the said Recognizance
was become forfeited for not appearing to Prosecute the said
Hugh Mc. Daniel And further Saith that on Receipt of the
said Letter he went to the Clerk of the Peace's Office when Mr.
Eyles Searched and told this Deponent that he could not find
there was any such Indictment against the said Hugh Mc. Daniel
