Brief for Prosr.


Case
Prosr. speaking in the hearing of the Deft. Burn that one Tilly owed him £2.4s
Deft. Burn sd. he wod. get him this Money asked where he lived upon hearing his
Name & place of abode went to the other Deft. Chapman who readily sd. he wod.
get his Money as then being allows had Court Officers Chapman without asst. made
or writ takes sd. Tilly got the Money and gave the Prosr. Ramillies brot £7.4s.4d [..]
Pro. acquainted his [..] sd. Chapman white a Rule of his Court
to shew Cause for his very bad behaviour according Prosr. went to Wm. Kells< no role > all and
of the attss. of that Court who immediatly servd. sd. Chapman and was to have appeared
the friday following. But on the Day before sd. Chapman procured a Person by the Name
of Jones who swore a Debt. agt. Prosr. of 99s as will appear from the Copy annexed taken
from the Tower Court Accordingly Chapman accompained with Deft. Smith Burn &
Mahony came to the House of one Jones who Reeps the Swan in Butcherow Et. Smith
feild where the Pros. was) first Chapman sd. to Mahony ther's the Booger your Prisoner
NB Mahony< no role > is Since Dead Pros. was draged away by ale the Defts. from the Swan aforesd. to
the Tower Prison, & in his way was treated in a most and and barbarous manner
particularly by Chapman & Smith beat along the Streets with great Sticks, & had
there been several Pet. & proper Officer & a just writ, the place from where Pror. was taken

in Quire Bail & entirely means to evade Justice by villanous Principles as being a
Person of as infamous a Charectar as Exist He is the Person that Swore a Sheat Robbery
agt, Billingsly & Wilkinson< no role > for Robing him of 4 Guineas & a silk hand kechief
they were Surrenders Chapman runway wod, not come into Court They were Discharged
by Barron Adams Dift, Smith now is the Person that has gave Notice of Tryal for
Friday next which is annexed Chapman is under Recognizance but dont intend to appeal
Please to observe that no Person on Earth could be so barbarous by treated as the Pror. at the time of
his being Arrested sd, Chapman also procured a Person to lay a Detainer for an Asst, agt. him
at the same time he was Arrested & was as innocent of one as the other the Pros. Ramilies
apprehends from the past behaviour of Chapman & Smith that they nere intued to some
to Justice from the past prays you to move that none of the Deft. in this Cause may have
Certificate from the Clerk of the Peace Prosr. being at a very large Expence in order to
being than to Justice but in Vain & immagines now that Deft. Smith dont intend to appear
