The King agt Michael Browfy< no role > One the Prosecutions
of Alexander Hume< no role > for an Assault and Fabs imprisonment

Thomas Morris< no role > of Saint Catherines Lane in the
Preceints. of Saint Catherines near the Tower of London
Peruke maker Maketh Oath and Saint that he this
Deponent went with the above Defendant Michael Browfy
to John Sherwood< no role > Esqr. One of his Majestys Justices of
the Peace , for the County of Middlesex on know what day it would suit hipe to be at
Hickss. Hall that he may give Notice of Tryal to the
above Prosecutor in the above Cause on that Day the said.
Justice being a Material Witness for the Defendant
therein, and could not Proceed to Tryal with Safety
Without his Evidence when Mr. Sherwood said that he
could not be there with Tuesday not wednesday and Thursday
was County day but that he would be thereon Friday
accordingly the Dept. gave the Prosecutor Notice of Tryal
for that Day the Coppy of which is a next

The Deft. at the time he gave the above Notice of Tryal
did not know the Rule of Court, that all Notices of Tryal
Should be given for one of the first three days in Session

Therefore please to [..] the Court [..] that the
Deft may come in on theat day to take his Tryal accord [..]
to his Notice for the wason above Assigned

But if the Court should not grant it that it may
Stand over until next Sessions without any further
Expence to the Defr.
