The King on the Prosecution of Sarah

for an Assault

William Holmes< no role > the above named Defendant Maketh
Oath and saith that he this Deponent and the other Defendant
having Given Notice to Try their Traverse upon the Indictmt.
Preferred by the above named Prosecutrix this Day at Eight of
the Clock in the Morning and this Deponent saith that he [..]
the other Defendant should accordingly have come into Court
and room their Tryal pursuant to their Notice, but that one
Mr. John Leatham< no role > who is a Material Witness for these Defendts.
and without whose Testimony this Deponent was Advised he
coned not Proceed with safety to Try this cause, was absent, And
that this Deponent has been and seen several times after the said
Mr. Leatham to Subpeena him could not find him and did all in
his Power to Subspeena him this Morning which was the reason
this Deponent could not attend the Court in time to take his Tryal but
that the said Mr. Leatham came into Court soon after the cause
was called on And this Deponent Possitively saith that he did
not keep out of the way with any View or Design to Evade his Tryal
or put the Prosecution to any Trouble or Expence
