George Long< no role > one of the Prossecutors against the Deft
George Duncan< no role > maketh Oath and Saith that he
haveing a Subpena under the Seal of this Honble
Court directed to Sarah Ward< no role > who is a Material
witness for the Pet agt. the said Deft without
whole Testimoney this Cause cannot Safely be
tryed as he is Advised and believes And further
Saith that he hath deligently endeavourd to Serve
her therewith to Procure her attendance this day in
this Honrble Court but upon Enquiry after her
he this Defont. was informed by her husband at
his house in St. Johns Street that the said Sarah
his wife was gone out of Town to avoid the
danger of being Infected with the small pox
with which her Children was then Sick with that
Same Believes But this Deft. Suspects and
verily Believes& Suspectthat She Conceals her Self
by the desire of the Deft on purpose to avoid
being Served With the Said Subpene
