Maketh Oath and Saith that he this Deponent at the Session of
the peace of the County of Middx holden at Hicks Hall
on Wednesday last
preferred and found a Bill of Indictment against the above named Joseph
Smith< no role >
for Feloniously stealing divers Cork Screws the property of this
Deponent And this Deponent saith that he being directed by the Court held
at Hicks Hall
as aforesaid to attend the Session to be held at the Old
Bailey
Yesterday at ten in the forenoon he this Deponent did accordingly
attend at the Old Bailey
as he was ordered, where he this Deponent was
informed that as the Name of the said Deft. was not incerted in the List
of the prisoners against whom Bills are found he this Deponent need not
further attend there on that Day And this Deponent saith that the Court
at Hicks Hall having ordered this Deponent to attend at the old Bailey
at ten in the Morning of the Yesterday he this Deponent apprehended that
the same hour this Morning would have been early enough for this
Deponent to have attended again. And this Deponent saith that he was
this day at the old Bailey
a quarter before ten of the clock in the Morning
in order to have given Evidence against the said Defendant for the said
Offence when this Deponent was Informed that the said Defendant was
Discharged by the Court there for want of this Deponents appearance to
give evidence And this Deponent positively says that he fully intended to
have prosecuted the said Defendant for the said Offence according to the
Condition of the Recognizance entered into by this Deponent for that purpose
And that the said Defendant was Discharged thro' the Ignorance of this
Deponent of the propertine that he ought to have attended and not thro'
any Inclination or Design of him this Deponent
