Richard Knibb< no role > of Butcher Row saint Katherines near the
Tower Tallow Chandler one of the Defends - in this prosecution
maketh oath that Richard Carbery< no role > the presecutor in this Cause
having in September Session last preferred an Indictment against
this Deponent and others for an assault he this Deponent did the
last Session plead there to not Guilty and there upon entred into
a Recognizance for Trying his Travers there on this present
Session And this Deponent Saith that he hath used his utmost
endeavours to find out the said prosecutor in order to Serve
him with of tryal in this cause but after the most diligent
Inquiry this Deponent cannot hear where he is though this Depont.
enquired after him the said prosecutor at Saint Katherined
bring his last place of abode and at divers other places and
this deponent further Saith that he hath been informed by Several
of the said prosecutors Neighbours and verily beleives that the
said prosecutor quitted his late Dwelling House at St. Katherines
aforesaid in the right time and now keeps out the way And
this Deponent further Saith that he hath applied to Several of
the said prosecutors friends and acquaintance and to Mr. Warriner
his sollicitor in this Cause to be informed by them where the sd.
prosecutor lived or might be found to be served with the notice
aforesd. but they or either of them could not or would not give this
Deponent any Informacon therein And this Degt. further Saith that if he
cod. haus found out the said prosecutor he this Dept. would have tryed
his Travers on the sd. Indictment according to his Recogniszance
entred in to for that purpose
