on the Prosecution of Michael
Henderson
< no role > for a Felony in Robbing
his Lodgings.

Michael Henderson< no role > of the Parish of St. George in the last in the
County of Middlesex Blacksmith and Martha Nicholls< no role > of the Parish of
white Chapple in the said County of Middlesex Wife of Joseph Nicholls< no role >
of the same Broker Jointly make out as follows, And first these
Deponts. both on their Oaths say that on the last day of the last
Session they these Deponts. were both Bound over by Mr. Justice
Quarrell to Prosecute the abovenamed Defendt. Robert Parry< no role >
for a Felony Committed in the Dwelling house of the Depont. Michael
Henderson
< no role > , and pursuant to such Recognizance so Entred into
They these Deponts. did both attend on Tuesday last at Hick's
Hall & did then and there Prefer and find Bill against the said
Robert Parry< no role > for the said Felony, and both these Deponts. Say
upon their Oaths that they have both Attended at this Honble Court
from Wednesday Morning Ten o' Clock till the hear of Eight of
the same Evening, and these Deponts. Did then Depart to their own
homes Imagining it was Impossible that the said Robert Parry< no role >
cou'd be that Day Tryed, he not being Inserted in the list of Prisoners
which these Deponts. Carefully Read over, and these Deponts. further
Say that they have both of them Attended both yesterday and this day
on this Honble Court the whole day untill this time in order to
Prosecute the said Robert Parry< no role > pursuant to their sd. Recognizance,
and these Deponts. still not finding the name of the sd. Robt. Parry
not Inserted in the sd. List, Occusioned these Deponts. to make a Strict
Enquiry ino the Reason thereof what these Deponts. ( to their very great
Surprize) were Informed that the sd. Robt. Parry was discharged for want
of prosecution an these Deponts. say that their Surprize was the
Greater, they having Attended doing the cokele time of this present session
and not finding thesd. Parry's Name Inserted in the sd. List nor not having
heard either of their Names called not with standing they used their utmost Indeavours
for that purpose, and always Intended to prosecute the sd. Parry for the sd. Felony

Both Sworn in Court at the old Bailey the 5th. of Septr . 1746.
