What Persons shall be adjudged to deal more in other Goods than in distilld Liquors

And if the Justices err in their Construccon of this Exception in either of these Points & under
Such Error Quarter Soldiers on Persons not liable. They & the Constables are
lible to Actions, which is a great Discouragement, & often attended with delays
and Inconveniences to the Soldiers who are to be Quartered, as well as to
those who Quarter them.

For Remedy of these Inconvenices Itt is Propos'd
That in the next Act for Quartering Soldiers, The
Exception may be to the Effect following (Vizt.)

Other than & except the House or Houses of any Distillers , who keep houses or Places
of Distilling Brandy or Strong Waters, & have fix'd & Set up therein one or
more Still or Stills capable of Distilling Gallons at least of Strong
Waters at one time (or if thought more proper, who Distill therein
every Year upon their own Account the Quantity of Gallons or
more of such Strong Waters) And who do not suffer Tipling in their
Shops or HousesAnd other than & Except the house of any Shop keeper
whose principall Dealings shall be more in other Goods & Merchandizes
than in Brandy & Strong Waters, who do not permit or suffer Tipling in his
or their Shops or houses, and who shall have a Licence or Licences
under the Hands & Seals or two or more Justices of the Peace of ye. County
Citty or Liberty wherein he or they shall dwell or keep such Shops or houses
for the Selling of such Liquors by Retail in such Shops or Houses
And in noe other, and in no Private houses whatsoever Etc.

It these Amendments are not thought proper, [..] is desir'd That the Exception may be
explain'd & more clearly worded, That the Justices may be better able to Judge
where & on whom to Quarter the Soldiers, That the Constables may be incourag'd
to do their Duty by the Security they will find in the Plain words of the Law, &
That the Soldiers may be received into the Quarters appointed them, without
the delays & difficulties, which at present attend them from the doubts & disputes
about the true meaning of this Clause.

These Observations & Amendments to the Exception in the Clause above menconed in the
Act for Quartering of Soldiers, are directed by the Justices of Middlesex in their
Quarter Sessions assembled at Hicks hall on the 12th. day of October 1721 to be
laid before the Honble. George Esqr. his Majesties Secretary of War by
