Upon the humble peticon of Richard Roome< no role > of the parish of Finchley
in this County preferred unto her Maties. Justices of the peace at
the last Generall Sessions of the peace held for this County on
the third day of December last , settingforth that the petr. had been
employed by Henry whitchcot < no role > of Finchley aforesd. Esqr . to digg
gravell for repaire of the Churchway of Finchley aforesd Scalled
Neither street , and that the Petr. had accordingly dugg seventy
four loads of gravell, and that the sd Mr. Whitchcot agreed to
pay the Petr. one shilling P load for digging such gravell, and
that the sd. Mr. Whitchcot afterwards refused to allow the Petr.
any more then about six pence halfe penny P load for the
digging thereof, and that the Petr. was much aggreived thereby
& was very poor, and praying to be releived in the premisses,
It was Ordered by her sd Maties. Justices of the peace that it
should be referred to Daniel Niccoll< no role > & John Cleeve< no role > Esqrs . two of
her Maties. Justices of the peace for this County or either of them
to examine into the Matter of the Petrs. complaint and to give
the Petr. such releife in the premisses as to them or either of them
should seem meet upon hearing of both parties, Now upon the
report of the sd. Mr. Cleeve made unto this Court that he had
been attended by the Petr. & the sd. Mr. Whitchcott and that he
found the sd Mr. Whitchcot did agree to pay the Petr. one shilling
P load for digging of the sd gravell and that after that rate
there was due to the Petr. from the sd. Mr Whitchcott for the
digging thereof the sume of three pounds & fourteen shillings
whereof the Petr. hath reced fourty shillings only in part, and that
the sd. Mr. Whitchcott doth still refuse to pay unto the Petr. the
residue of the sd. three pounds fourteen shillings amounting to
one pound & fourteen shillings It is Ordered by this Court that
the sd Mr. Whitchcot doe forthwith pay unto the Petr. the sd sume of
one pound & fourteen shillings, as he the sd Mr. Whitchcot will
answer the contrary at his peril
