WHEREAS the Inhabitants of the Parish of St. Giles in
the Fields , in this County, have lately built and erected a
certain House there, whereof they have appointed one Tho
mas Smith< no role > (a Beadle of the said Parish) to be Keeper.
And whereas the Constables, Headboroughs, and Watchmen of the Said
Parish have, since the erecting of the said House, commonly carried
persons apprehended in their Watches, and others commited for want of
Bail, to the House aforesaid; and there the Said Thomas Smith< no role > hath recei-
ved and detained them as in a Prison, for matters belonging to a Justice
of Peace , and Several criminal Causes and Misdemeanours; Which pro-
ceedings of the said Constables, Headboroughs, Watchemen, and Keeper,
this Court doth declare to be altogether illegal and unwarrantable. It is
therefore Ordered by this Court, That if any person or persons shall
hereafter be carried or conveyed by the Constables, Head - boroughs and
Watchmen of the said Parish, or any of them, to the Said Prison, and
there be received and detained by the Said Thomas Smith< no role > , or any other
person Whatsoever, for matters belonging to the Connusance of a Justice
of the Peace , or any criminal Cause or Misdemeanour, That as well the
Said Constables, Head - boroughs, and Watchmen, and every or any of
them that Shall So carry or convey any person or persons to the Said Pri-
son, as he the Said Thomas Smith< no role > , and any other person whatsoever, who
Shall receive and detain any person or persons in the Said Prison, for the
Matters and Causes aforesaid, or any of them, Shall be Indicted, proceed-
ed against, and prosecuted for the same, and that the necessary Charge of
Such Indictments and Prosecution Shall be from time to time born and al-
lowed out of the Stock of this County.
