Whereas Gerald Byrne< no role > Gent hath lately Petitioned the Majtie: setting
forth that haveing had the Oathes now by Law directed tendred to
him in June last by the Justices att Hicks Hall, he desired time to
Consider thereof wch was granted him Notwithstanding wch he had
been prosecuted for Retusancy with all severicy & his Papers &
writeings seized & taken from him [..] Peticonrs Majtie has been
pleased to Refers to me to examine the matter thereof, and in case
the peticoners Case should appeare to me to be finely stated
to came the proceedings agt: the said Gerald Byrne< no role > to be stept and
his Papers &Writeings Rescored, The Peticoner first takeing the Oathes
menconed in an Act of the last Session of Parliamt: Entituled an
Act for the Abrogacaing me Oathes of Supermacy & Allegiance &
appointing other Oathes And whereas he appeares come by a
Certificate under the hands of severall of their Majts: Justices of
the Peace of the County of Middx that the said Gerald Byrne< no role >
did before than att a private Sessions held in Bloomsbury on to
the seaventh day of this Instant February actually take the
Oathes above menconed

These are therefore to Authorize & desire you to enter
a Noli Prosegin on the Indictmt: agt: the said Gerald
Byrne
< no role > for Retusancy & forthwith to restore to him the said Mr
Byrne his Papers & writeings soe seized as aforesaid
And for yor: soe doeing this shall be yor: Warrant
Given under my hand this Tenth day of January
1689.
