As to the 2d. Objection - It is very well known that both Butchers
and Barbers Shops are open till twelve o' Clock a Saturday Night,
and tho it is often Said poor persons do not receive their Mony their
daily or Weekly Pay till late on Saturday Night, yet if that be
inquired into, it will most probably be found very few if any of these
Persons but are paid by or before eleven a Clock in the Evening, So
that there is time enough to buy what they want that Night and as
either Markets or Butchers Shops are So many & So differently
dispersed, it will be difficult for them to go home without passing by
a Butchers Shop or if that is not the Case they need not go far from
their own Habitations to accommodate themselves. But Should any
Person be unprovided with Money So as not to be able to lay in any
Provision for a Family on the Saturday Evening, or taken Sick So
that it would be necessary to apply either to Butcher or Poulterer
on the Lords Day Morning, these and other Cases may be considered
under the head of Necessity and Charity for which the Act of
Parliament has made a Provision and would have their proper
weight with the Court on being made out to their Satisfaction,
but Should have no Force or Effect in preventing the punishing of
those whose Case is not attended with Such or the like Circumstances.

As to the 3d. Objection which consists of two parts. First That
it is too Strictly carried into Execution as to Persons your
Committee observe that by the 29.Car.2.c.7.s.3. It is provided that
nothing in this Act contained Shall extend to the prohibiting of
dressing or Selling of Meal in Inns, Cooks Shops or Victualling
Houses, under which Provision they are of Opinion baking Meat
or Pies for the accommodation of a Family and thereby giving
greater Liberty & Opportunity for Servants to go to Church may be
included and intended and therefore think Should any Person be
indicted for that and that only the Jury may be Charged to acquit
Such Defendant.

As to the 2d. Part of the Objection that this Offence is too Strictly
Carried into Execution as to time, Persons having been punished for
what was done before Nine a Clock Sunday Morning, your
Committee on perusing the Act of the 29.Car.2d. find the Penalty
there inflicted extends to all Persons who exercise the Business [..]
or Work of their Ordinary Calling upon the Lords Day or any part
thereof, So that the Legislature makes no Difference as to time,
