The King agt. Richard Elliott< no role >
for a Misdemeanour

John Chandler< no role > of the parish of Saint Saviours Southwark
in the County of Surry Oath Hatter maketh Oath that on or about the
Tenth day of May Instant He this Deponent Caused One Richard
Elliott
< no role > a person of bad Fame and a common Gambler by Repute
to be taken up and Carryed before the Right Honble the Lord Mayor
of the City of London for unlawfully Defranding this Deponent of the
Sum of Ten Pounds and upwards at Cards at the Sign of the Bull and
Butcher in Smithfield whereupon his Lordship the same Day
Committed the said Elliott to Newgate for the said Offence And bound
this Deponent by Recognizance to Prosecute the said Elliott at his
Session for the said Offence And the said Elliott has since been
admitted to Bail And this Deponent Saith that he being
intirely Ignorant of the nature of Carrying on such prosecution
Did attend at Hicks Hall by wrong advise in Order to find a Bill
against the said Elliott Expecting he should have been called on his
Recognizance so Entred into as aforesaid But being Informed of
his mistake he this Deponent Came this Day to Justicehall in the
Old Bailey betwixt the house of three and four of the Clock in the
afternoon with a Real Intention of preferring a Bill of Indictment
to the Grand Jury Sitting for the City of London as he Expected there against the said
Richard Elliott< no role > for the said Offence But to his great Surprize upon
Enquirytherefound that the said Grand Jury were Discharged And this
Deponent positively Saith that he has out Committed this mistake
with a Design that the said Richard Elliott< no role > might Escape with
Impu [..] ity for the said Offence [..] And
therefore he hope, that the said Elliott shall be Continued he
Recognizance and that he shall find Bail to Appear at the next.
Session for this City as this Dept is ready and willing to be contiuned
on his Recognizance to Prosecute the said Richard Elliott< no role > or to
Enter into a flesh Recognizance to prosecute the said Richard
Eliott for the said Offence at the next Sessions with Effect
