2ndlyThe Rigour of Proceeding is so softened, that no Warrant can issue
agt. the Defts. on the Indictment.
And the other possible Consequences, in the breast of the Prosecutor,

1stare A total Suspension of all further Proceedings, the Prosecutor not being
Bound to ProsecuteOr
2ndlyAn Acquittal without Trial; by the Prosecutor's himself suffering yo.
Defts. tho' without Cause, to Demur to the Indictment, and to Enter up
Judgment for want of a Joinder in Demurrer.
