The certain Consequences of which Writ (unless a Procedendo is ordered)
are
1st: The forfeited Recognizance of the Deft. will be absolved.
2:dly The Rigour of proceeding is so softened, that no Warrant can Issue agst.
the Defts: on the Indictment
And the other possible Consequences, in the breast of the Prosecutor
are
1st: are A Total Suspension of all further Proceedings, the Prosecutor not
being bound to Prosecute or
2:ndly An Acquittal without Trial; by the Prosecutor's himself suffering ye
Defts. tho' without Cause, to Demur to the Indictment & so Enter Up
Judgement for want of a Joinder in Demurret.
