such Overseer or Overseers to the person or persons who shall be authorized by
the said Governours and Guardians to receive the same It shall and may be
lawful to and for any one or more of his Majesty's Justices of the Peace for the
Counties of Middlesex or Surry, the City and Liberty of Westminster or the
Liberties of the Tower Hamletts respectively to Summon the Overseer or
Overseers who shall refuse or neglect to make such payment and to Order
immediate payment to be made of so much as shall appear to such Justice
to be due together with such Costs and Charges as may have been in curred
by the said Governours and Guardians in consequence of such refusal &c
neglect And if the Overseer or Overseers shall refuse or neglect to obey the
Order of such Justice or Justices the Sum directed to be paid thereby
shall be recvered by distress and sale of the Goods and Chattels of such
Overseer or Overseers together with the Costs attending such distress and sale
sending the Overplus (if any) to the Curters"

The foregoing is the only particular Method pointed out by the sd.
Act of Parliament for the recovery of the Charges of the maintenance and
Education of the Parish Poor Children, and that with regard to such only
as may be admitted into the Foundling Hospital , and as the Warrant of
any of the sd. Justices mentioned in the sd. Act cannot be legally executed
in the City of London and Freedom thereof where the Aldermen of London only
Act as Justices, And as no power is given by the said Act to the Aldermen
[..] Summon the Overseers or grant any Warrant of Distress the same
must have been owing to a mistake or Oversight in framing sd. Act, or Else
[..] is Apprehended that notwithstanding the Seventeen Parishes without
the Walls of London being expresly mentioned in the sd. Act as aforesd. with the
Parishes in London Middx and Surry in which there are 23 Exclusive
of the Middx parts of the sd. seventeen Parishes witht. the Walls of London
Get that the Act meant only to include such parts of the sd. Parishes as are
within the County of Middx

Qur.

Are the Freedom Parts of the sd. seventeen Parishes witht. the
Walls of London included within the intent & meaning of the
sd Act & obliged to Conform thereto.

The whole of this Parish & of the others denominated in this Act "the Seventeen
Parishes without the walls of London" appear to one to be subjected to these
Regulations, thor as to the part within the Jurisdiction of the City the provision
to enforce the paymt. is defective for want of it's being extended to the Magistrate
of the City, which is an Omission that makes an amendment necessary
