Oath a Prosecution for Reckerning
four Transportation

Thomas Erskine< no role > This name instance is in set 3649. the above Deft maketh Oath
that Robert Thomson< no role > is a Material Witness for
this Deponent in the above Prosecution and
without whose Testimony this Deponent Court
safely Proceed to Tryall and Saith that the
said Robert Thompson did Attend at the last
Session to give Evidence for this Deponent but
Connot now be here by reason he is ill of
a Feaver at Both but not able to Attend at this Deponent is Credibly
Informed and Believes & Saith that he doth
not make this his Affidavit to avoid Justice
but merely that the Fifth of his Case
may Couce before this Honourable Court
and will if the said Robert Thompson recovery
from his said Disoder use his atmost Ersdeavoy
to have him here at the next Session

Sworn at the Session in
the Old Bailey the 19th.
day of May 1774 }
