the Defendant abovenamed Maketh
Oath and Saith That he this Deponent Employed
a Person of the Name of Handsdon whom this Deponent
understood was an Attorney to defend this Indictment and gave the said Handsdon
Money on account to take care of the business But this
Deponent Saith That he hath Since be he in formed the
Said Handsdon is not an Attorney and that he hath
Neglected to give the Usual Notice of Tryal to the
Prosecutor or taken out a Venire and hath Wholly
Neglected the business Whereby this Deponents Recognizance
is become forfeited as this Deponent is on found And this Deponent
Saith That it was his Intention to have taken his Tryal
upon the said Indictment at this Present Session if the same had not been
Neglected by the said Handsdon as above Stated And therefore
humbly Prays this Honble Court to Order That the Recognizance
May be respited till next Session
