His King agt. the Parish of St. Mary Islington

The Defts have given Notice for tomorrow the [..]
they will come in and shew that the Road in repaid
paid prove to discharge their Recognizance
The facts are that Mr. Cox the Prose. is ill
of else he sd have attended at this Session to have
made in Abbt that he has been at the whole
Peace of the Prost. & that no Subscription has
been entered into for the purpose of defraying the
penceThe Cause having stood over from the
last Sessions for this Purpose, so as to induce the Court
to make an Order for the Deft to pay the Prosr his
Costs & with respect to the Road the fact is it is
not Yet completely repaired according to the charge in the
Indictment neither as to the distance nor from the
Terminar ad quo& ad quen, Youll please therefore
to resist this Motion, by objecting to the Recognizance being
discharged first, until the Road is thoroughly repaired
and secondly until the Costs of the Prosr. are paid to Mr
Cox or his Sollicitor Mr. Cox cannot attend as appeal
