the above named Defendant maketh Oath
that he this Deponent did on the Third day of
January instant go to the house where the above
named Prosecutor resides in
Cow Lane
Smithfield
in order that Notice of Tryal might be served
on the said Prosecutor for the Defendant to Try
his Traverse at the Present Session but on this
Deponent making enquiry for the Purpose aforesaid
Held Deponant was informed by the Landlord of the
said [..] here the Prosecutor resider that the
said Prosecutor [..] was out of Town but where
She could not inform this Deponent or when he would
return, And this Deponent further saith that the
Prosecutor is only an inmate or Lodger and he follow
[..] the Occupation of a Bricklayers Labourer
and frequntly as
[..]
this Deponent is informed out of Town, therefore this
Deponent humbly hopes as there is great uncertainty
in Serving the said Prosecutor with Notice of Tryal
Personally the Court will Please to order that Service at the
last place of abode of the Prosecutor made be declned
good Service
