Assault

Edward Ivory< no role > of Roys Building in the Parish of
Saint George Chelsea in the County of Middlesex One of
the above named Defendants in this Prosecution maketh
Oath that he this Deponent did on Wednesday the Third
day of April instant go to the house of the Prosecutor
Simon Webb< no role > in Peter Street in the Parish of Saint James
in the County of Middlesex aforesaid in order to have
served him with a Notice in Writing purporting that he this Deponent
and the other Defendant Patrick Moran< no role > meant personally
to be and appear at the then next General Sessions of
of the peace to be held in and for the County of Middx to be
holden on Clerkenwell Green on Tuesday the Ninth day of
April them and there to try their Traverse on a Bill of
Indictment preferred by the Prosecutor against this Deponent
and the other Defendant Patrick Moran< no role > , And that he this
Deponent when at the house of the Prosecutor in Peter
Street aforesaid enquired of a Person (who said she was the
Wife of the Prosecutor) for the said Prosecutor Simon Webb< no role >
in order to have served him personally with such Notice in
Writing when this Deponent was informed by the Prosecutor said Wife
that the Prosecutor Semon Webb< no role > went on Ship board
Fortnight then ago and was use on his Vsyage to Philadelphia
and she did not know when he wou'd return and which
information this Deponent believes to be true-therefore this Deponent
and the other Difendant Patrick Moran< no role > are not able
to Proceed to the Trial of this Indictment the prosecut
Sessions as personal Service on the Prosecutor of the said Notice of Trial is
