Thos. Casey< no role > for an Assault

John Myler< no role > of Lascelles Court Broad Street in the County of
Middlesex Yeoman the Defendant in this Cause Maketh Oath
and Saith That on the 17th. day of May instant he this Deponent
did cause Notice of Trial to be given to the Prosecutor Thomas Casey< no role >
and did take a Venire and Set down his Cause for Trial And this
Deponent Saith that the said Prosecutors Attorney Mr. Mc. Cabe
called on this Deponents Attorney as he has been informed and
daily believes, for to settle this prosecution by arbitration and this
Deponent for that reason did not Subpena any of his Witnesses
to appear on his behalf And this Deponent further Saith that
the said Prosecutor and his said Attorney met this Deponent and
his Attorney and did agree to settle this matter by Arbitration and
for that purpose the said ProsecutorDeponentand this Deponent accordingly
executed Bonds of Arbitration but on account of the said
prosecutors Attorney not consenting to this Deponent being
discharged from the said Indictment, this Deponent and the said
Prosecutor did not agree to the said Arbitration And the said
Prosecutor was Determined to proceed on the Indictment against
