Saith that on the tenth day of February One thousand
Seven Hundred and Ninety in last Hilary Term the said
men names Spurrier by his Counsel moved this Honorable
Court to make the submission to the said Award a Mute
of this Honorable Court which wea accordingly granted
And this Deponent further saith that upon his hearing
that the said Benjamin sp [..] onier had so made the said
Award a rute of this Honorable Court, He this Deponent
on the next day the eleventh day of the same Month
of Febrary in the same Hilary form by is Counsel
moved the Honorable Court for a Rute to shew Cause,
only the Rute obtained to make the Submission to the said
Award a State of Court Should not be set a side Together
with the award so far as the same related to him this
Deponent And that Samuel Best< no role > of Kirby Street in the
County of Middlesex Gentleman (an Attorney and also a
principel concerned in the said differences and bound
by another [..] ration bond to abide by the said Award
of the said frances Const, and, who enlarged the said
Liberation Bond without the consent of him this deponent
from the Smith day of November One thousand Seven
Hundred and Eighty nine to the twenty third day of the
Same Month should pay the Costs of the said Application
And this Deponent further saith that this Honorable Court
granted him a mute accordingly for the said Benjamin
Spinner
< no role > and Samuel But< no role > to Shew Cause on the Second Day
of next Enter Term to the effect last above mentioned
