Middlesex to wit


Norton Rabaliat of Princes Street in the Parish of Saint
Margaret Westminster in the County of Middlesex Gentleman and
William Gymer of the Little Sanctuary in the said Parish and
County Gentleman severally make Oath and say And first
this Deponent Norton Rabaliat saith that previous to the present
Sessions of the Peace now holding at Clerkenwell in and for the
County of Middlesex he did not give or cause to be given Notice for
the Tryal of this Traverse to the Prosecutor John Baynes< no role >
because he and the said Prosecutor since the last Sessions holden
in and for the said County of Middlesex had finally agreed as this
Deponent thought and fully believed to refer to the said William
Gymer
< no role > the Arbitration and final settlement of this Cause for
this Deponent further saith that about two weeks ago the
said William Gymer< no role > as the friend or Agent of the said John
Baynes
< no role > informed this Deponent that he the said John Baynes< no role >
would not Consent to a Reference of the Matters in dispute
in this cause to any other Person but him the said William Gymer whereon
this Deponent told the said William Gymer< no role > that he had no
objection to him as an Arbitrator and that he agreed thereto
and would fully and absolutely abide his determination and
thereon this Deponent supposed this prosecution had ceased
and under that Idea never applied to his Accomey to prepare
for his Defence thereto And to which Prosecution this Deponent
hath a very good Defence and hath not nor ever had a wish to
delay the Tryal thereof And this Deponent William Gymer
for himself saith that about two-Weeks ago the Prosecution
John Baynes< no role > positively fixed upon and denied him to take upon
himself the Arbitration and Settlement of the Matters in
dispute in this Cause and he this Deponent having agreed
thereto he Communicated the same to the said Defendant
Norton Rabaliat who also agreed thereto and fully to abide
and perform the Award or determination of him this Deponent
And this Deponent William Gymer further saith that having
heard and examined both the parties touching the Differences
