when Trail of the said Prisoner was put off for the
reason by the said William Smith< no role > as before alledged
And this Deponent William Smith< no role > further Saith that
in the mean time & before the said last February Session
the affairs of this Deponent become greatly Embarrased
in so much that a Commission of Bankrupt was awarded
against this Deponent when through the great Agitation
of the mind of this Deponent he omitted to attend and
prosecute at the said February Session Whereby the
prisoner was discharged for want of prosecution
And Lastly this Deponent William Cook< no role > for himself
further saith that being Ignorant of law matters and
who by depending on his said Master for information of
the necessary time this Deponent should attend to give such
Evidence this Deponent for the reason last aforesaid
As also through the Confusion this Deponent andas alsohis [..]
Master were in on Account of the said Bankrupty
wholy omitted to attend this honorable Court And both the
Deponents say that such neglect did not arise through a
favor towards the prisoner But on the sole Account afore [..]
