maketh Oath That in or about
the begining of the Month of June last this Depont.
was bound by a Recognizance taken before Mr
Justice Hyde to prosecute the sd. John Burnell< no role >
for
obtaining from & defrauding this Deponts. of certain promisory Note of Hand of the
Value of £42. of this Deponent under false pretences
and at the same time one Thomas Squire< no role >
was
also bound in another Recognizance to give Evidence
on the same Transaction And this Deponent
saith that he hath been ever since ready & willing to
prefer an Indictmt. agst. the sd. John Burnell< no role >
for the sd.
offence & Shod. have preserred the same but that this
[..] Deponent hath been advised & verily beleives such
[..]
Indictment wod. not have been found by the Jury upon
this Deponts. Sole Evidence And this Dept. further saith
that he hath made very street & diligent Enquiry after
the sd. Thos. Squire< no role >
with a full Intent & purpose to prevail
on him to give Evidence upon the sd. Indictment but
hath not been able to gett the least Intelligence of him
for that purpose which is the sole Reason why this Dept.
hath not preferred his St. Indictment agst. the sd. Burnell
