for the Deft in this Cause maketh Oath and
saith that sometime after the Indictment in this Cause was preferred
by the Prosecutrix Frances Remnant against the said Defendant
Margaret Lloyed She the said Prosecutrix commenced and Action in
the Court of things Bench against the said Defendant for assaulting
her the said Prosecutrix and employed one William Elliot< no role >
who
now resides in
Bridge Street
Blackfryars
London
as her Attorney
therein who hath given Notice of Trial in the said Action for the
Sittings of Nifi Prices to be held for the said Court at Guild hall
London
after the last Michaelmas Term but he said Trial is not yet come on And this Deponent Saith that not
being able upon Enquiry to find out where the said Prosecutrix
was to be met with he this Deponent did on Wednesday the
Twenty ninth Day of November last personally serve the said

who then acted as Attorney for the said Prosecutrix
in the said Action with the Notice of Trial signed by the said
Defendant, which is hereunto annexed by delivering to and leaving
with the said William Elliott< no role >
a true Copy of such Notice signed by
the said Defendant and the said William Elliot< no role >
promised to deliver
the said Notice to the said Prosecutrix but would not tell this Deponder
where She was to be met with And this Depender saith that such Notice
of Trial hath not been since countermanded And lastly this Deponent
saith that the said William Elliot< no role >
did on the fourth Day of December
Instant deliver to this Deponent a Notice in Writing with the Name
William Elliot< no role >
thereunto subscribed, which said Notice is hereunto annexed
Purporting that he should not prosecute the said Indictment any further
against the said Defendant.
