For an assault

Timothy Kelly< no role > the Prosecutor in this Cause maketh Oath that he this
Deponent did on the Twenty Ninth day of June Last Receive from the
Defendant in this Cause the Notice in writing hereunto Annexed and that
he received no Countermand whatsoever of the said Notice And this Deponent
Saith that in Consequence of such Notice he Caused a Subpena to be
Issued in this Cause for his Witnesses attend and give Evidence on
his behalf at the Last July Session and that such Witnesses were
Subpeened accordingly and attended this Court in Obedience thereto
And this Deponent Saith that a Brief for Tryal was prepared
and a Fee therewith given to Council in hopes that the said Cause
would be Tryed at the last Session According to the said Notice And
this Deponent Saith that the said Defendant did not Sue outany
Venire in the said Cause neigher has he given any Notice to this
Deponent to try his Traverse at this present Session
