by the Lord Chief Justice Mansfield and was thereupon detained in
Custody till the Saturday following because the said prosecutor John Raper< no role > could
not be found to be versed with Notice of Bad thos he this Deponent
repeatealy desired to knows who he was and where he might be found and
that on the said Saturday he was carried before Mr. Justice Wilmot to be
Bailed who was pleased to discharge this Deponent upon Bail And this
Deponent further saith that during such his said Confinement a person on
behalf of the said Defedants made several offers that if he this Deponent
would Relase the said Defendants that Raper should Release him and
should be immediately discharged without further Trouble which he
refused to Comply with And the said James Reading< no role > for himself
saith that he this Deponent hath ever since the said Haviland was so
Arrested as aforesaid endeavoured by all ways means Searches and
Inquires he could possibly use or make to know who the said John
Raper
< no role > was and where he might be found in order that he might be
served with Notice of Tryal for this present October Session and that
notwithstanding all such his diligence to this Deponent hath not been
able to find out the said John Raper< no role > or his place of abide or any
thing of him And the said Robert Carpenter< no role > for himself saith
that at the request of the other Deponent Thomas Haviland this Depont
did apply to the Tipstaff who had the said Thomas Haviland so in Custody
as aforesaid to be informed where the said John Raper< no role > might be found to be
served with such last mentioned Notice of trial and the said Tipstaff
declared he never saw nor knew any thin of him but received his Warrant
from the said Defendant Pauley And Lastly all these Deponents
Jointly and severally respectively say that they do believe there is not any
such person as John Raper< no role > upon and that they neither Know or believe there is such a person as William Smith< no role > was [..] but that the said Presecution against the
Deponent Thomas Haviland is set on foot by the contrivance of the said
Defendants in a false and feigned name to distress the said Haviland and
exact Releases from him.
