of July aforesd. the prosecutors Attorneys or Sollr. or who Appeared
as such to the Number of three or more then Appeared in Court And
one of them having that Morning promised and undertaken to be
ready to Try the sd. Cause in the afternoon the Court was then pleased
to put it off till the Evening of same day but instead of bringing on
said Tryal as they promised they moved upon Affidts. to put it off
till September Sessions last at which time the Court declared to the best
of Deponents to remembrance that if they were not then ready Deponent
should be Tryed or Discharged in to that Effect And this Deponent
Saith that he heaving prepar'd and Subpened his Witnesses for his
Tryal last Sessions at very great Expense the prosecutors again
Applyed to put off the said Tryal till this present Sessions upon divers
false Affidavitt And this Depont. Saith that one Martha Oxley< no role > who
is a Material Witness for Deponent in this Cause and who was
Subpened to give Evidence last July Sessions on the behalf of Depont.
and who Attended thereon and who was again Subpened a few days
before last September Sessions but did not Attend to give Evidence
in this Cause on Deponts. behalf as aforesd. has been Spirited away
by the Prosecutors or same of them for that upon the Strictest
Inquiry which Deponent has Caused to be made after her at has place
of abode and other places whose she was known he finds that she is
not otherwise to be heard of than that she quitted her place of dwelling
near Saint Georges Church Southwarke after that she was Served
with a Subpena as aforesd. and a day or two before this Deponent
Tryal last Session was Expected to come on And this Depont. Saith
he is Informed and Verily believes the same to be true that a four
days before the sd. last Sessions the said Rowe Applyed to persons
to whom Depont. is not anyways Indebted as he knows of to Lodge
Accons against this Deponent in Order to further distress him And
Also since the said Sessions went to the Neighbourhood where Deponts.
Lodged before his Surrendering Accompained by the sd. Bucknall who
this Depont. Apprehends and has undoubted reason to believe is the Chief
Prosecutor
