he haveing Caused Notice of Teyall to be Prpaned in Writing in this
Cause for this Prsent Sessions of ye: peace held at Hicks's Hall in
St John Street in & for the Sd. County of Middx This depont. did
Immediately thereupon said for Sevall Days Since Make diligent
Search & Enquiry aftr. Chas: Langstaff< no role > ye Prosecutr. at Sevall
Places in Middx & London Where ye. Sd. Langstaff [..] this [..]
is Informed & alsoe beleives) Resided & often used to be In Order to
have Served him wth. ye. Sd. Notice And this Depont. Saith that
upon the Strictest Enquiry he Could make after the Sd. Langstaff
he was Informed by Sewall of his Neighbours & Accquaintance
That ye. Sd. Lang staff was Run away or Gone off & that
they Could not tell where he was Soe yt. this Depont. Could not
then nor Cannott yet find the Sd. Langstaff to Serve him
with the Sd. Notice of Tryall And this prsent Sessions &
Since the Same began he this Depont. Did alsoe make
diligent Search & Enquiry after [..] Mr. Stead & Mr. Far [..]
at their Sewall places of Aboad in Middx & London In Ord [..]
to Subpena them in this Cause Who are two Materiall-
Witnesses for ye. Deft in the Sd. Cause as this depont. verily
beleives & is alsoe informed And without Their Testimony
the Deft. Cannott with Safety (As this Depont. is advised
& alose beleives) proceed to Tryall of ye. Sd Cause And this
Depont. Saith that upon ye. Stridest Enquiry he Could Make aftr.
ye. Sd. Stead & Farley he was informed by Sevall of their Neighbls
& Accquaintance That ye. Sd. Stead & Farley are & have been
for Some time past out of Town or else have Removed their
Lodgings or aboads where this depont Cannot find then So that
its will be impossible for ye. Deft. (As he this depont verily beleives)
to have ye. aforesd. Witnesses at the Sd. Tryall Otherwise this
Depont. and alsoe ye. Deft. (As this Depont verity beleives) would [..]
have willingly proceeded to Tryall in this Cause
