that they are thereby frustrated from haveing the benefit of her
testimony this present sessions to make out the truth of the allegacons
contained in the sd. recited Order, It was therefore prayed that
the heareing & determining of the said appeale may be adjorned
untill the next Generall Quarter Sessions of the peace to be
held for this County, Whereupon and upon heareing of what
was insisted on by the Councell for the sd John Pether< no role > It is
Ordered by this Court that the benefit of the said appeale be
saved unto the said John Pether< no role > and that the heareing and
determining thereof be adjorned untill the next Generall
Quarter Sessions of the peace to be held for this County, And that
the Churchwardens & Overseers of the poor of the said parish
of St. James & all other parties concerned doe attend her Maties.
Justices of the peace at the next Generall Quarter Sessions of the
peace to be held for this County on the second day of the same
Sessions at ten of the clock in the fore noon to heare & abide
their Judgmt. & determinacon touching the sd. appeale And the
consideracon & awarding of costs is reserved untill the heareing
of the said appeale.
