make Oath and Say And first this deponent James Lyon< no role >
for
himself saith that since the Order of this Honorable Court
was made in last September Sessions to put off the Trial in
the above Prosecution on account of James Ivey< no role >
of
Narrow Wall
Lambeth
in the County of Surry
and Robert
Colliver< no role >
of the same place both Barge Builders
who were
material Witnesses in the above Prosecution and was kept
out of the way by the said William Cook< no role >
to avoid giving their
Evidence in the above Prosecution He this deponent did cause
Subpoenas to be issued out to compel the attendance of the said
James Ivey< no role >
and the said Robert Colliver< no role >
to give their Testimony
on the said Indictment and hath employed persons to serve
the same at their places of abode at Lambeth
aforesaid and [..]
other parts of London and to Ware
in the County of Hertford
when
this deponent was informed the said James Ivey< no role >
and the said
Robert Colliver< no role >
were likely to be found And this deponent
further saith that he was informed and verily believes sent information to be true by the persons so employ'd
that the said James Ivey< no role >
and the said Robert Colliver< no role >
could
not be found at any of the places aforesaid buthathhad absented
themselves from their homes in order to avoid such service
so that they cannot be found that such Subpoenas may be
served upon them And this Deponent saith that he was infor-
med and verily believes such information to be true that
