Indicted for perjury on
the Prosecution of John
Smith.

Goland Burton< no role > of Wapping in the County of Middlesex Mariner maketh Oath and
saith that he this Deponent did on the Twentieth day of October instant personally
serve Thomas Evans< no role > who acts as Solicitor for the Prosecutor in this Came as this Deponent
hath been informed and beleives with a true Copy of the Notice of Trial hereunto
annexed by delivering to and leaving with the said [..] Thomas
Evans at his House in John Street in the Minories London a true Copy of the said
Notice And this Deponent further saith that he did at the same time enquire of
the said Thomas Evans< no role > where the said Prosecutor was to be met within order that
this Deponent might serve the said Prosecutor with another true Copy of the said Notice
when the said Thomas Evans< no role > informed this Deponent that the said Prosecutor was
gone abroad and that he the said Thomas Evans< no role > could not inform this Deponent
when the said Prosecutor would come to England And this Deponent further
saith that from a further Enquiry which he this Deponent hath made respecting
the said Prosecutor he this Deponent hath been informed that the said Prosecutor
sailed from England in [..] called The Belisarius bound for the Coast of
Africa and both which Informations this Deponent beleives to be true And
this Deponent further saith that the above Indictment against the said Defendant
is founded upon an Affidavit made by the said Defendant to hold the said
Prosecutor to Bail for the Sum of Ten pounds and upwards due to the said Defendant
and that the said Indictment was preferred against the said Defendant
soon after the said Action was Commenced against the said Prosecutor and before
any Trial had therein And this Deponent further saith that after the said Indictment
was preferred against the said Defendant the said Action was tried before Mr
Justice Buller at the sitting of Nisi prices for the City of London for His Majestys
Court of Kings Bench and the said Richard Pickering< no role > obtained a verdict against
the said prosecutor on such Trial and that the Damages and Costs have not
yet been paid as this Deponent hath been informed and believes And this Deponent
saith that the said Richard Pickering< no role > is Master of the Ship or Vessel called The
Brashall in the Jamaica Trade and at the time the said Indictment
was preferred against him was under Orders to proceed on a Voyage to Jamaica
and in the Month of December last last set Sail on such Voyage
to Jamaica and returned from thence to the port of London on or about the
twenty fourth day of September last.
