and verily believes that it will be more adviseable
and proper for the Crown to indict and try the
Prisoner for the Offence of forging and uttering as true Knowing
the same to be forged the Will of the said James White< no role >
deceased [..] than for the Offence with which
he now stands charged but saith that the same
cannot according to the Rules and Practice of
this Court [..] as this Deponent understands and
believes be done until the Probate of the said
Will so granted to the Prisoner as aforesaid has
been called in and revoked or declared null and
void And Lastly this Deponent saith That he
will continue advertisements in the public papers
and make all other necessary Inquiries for
finding out the next of Kin of the said James White< no role >
deceased in order to ground a Clintron from the
Ecclesiastical Court in the Name of such next of
Kin for calling in and ever King or declaring such
Probate null and void and that he this Deponent
hath reason to believe and doth believe and expect
that he shall be able to discover such next of
Kin and thereby to obtain a revocation of the
said Probate on or before the First day of the
next May Sessions.
