The King on the Prosecutions of William James< no role > against Isabella Lyster< no role >

William James< no role > of Fleet Street in the City of London Victualler
maketh oath and saith that he this Deponent did on Wednesday the
fourteenth and on Thursday the fifteenth of December Instant attend
at the Sessions Hall in the Old Bailey in the City of London from about
Ten of the Clock in the Morning untill about five o Clock in the afternoon
on each of the said Days for the Purpose of giving Evidence against
Isabella Lyster< no role > on an Indictment for stealing Pewter Potts and this
Deponent further saith that about five o Clock in the afternoon of the
said fifteenth of December he this Deponent went to the Indictment
Office in the Old Bailey aforesaid and inquired of one of the Clocks
there if the Indictment against the said Isabella Lyster< no role > was found when he informed this Deponent he could not till
And this Deponent further saith that he then went from the Old Bailey
aforesaid to his own House in Fleet Street aforesaid for the purpose of getting
Refreshment not expecting the Trial of the said Isabella Lyster< no role > would be
called on that Evening And this Deponent further saith that at the time
he so left the said Sessions Hall as aforesaid he left one John Smith< no role >
(who was a Witness in the Prosecution against the said Isabella Lyster< no role > )
to call this Deponent in case the said Indictment was called on And that
about six o Clock in the same Evening the said John Smith< no role > came to this
Deponents House and informed him he had staid at the Sessions house
till he was tired and there being no Prospect of the Indictment coming on
and therefore he was going home or words to that Effect End this Deponent
further saith that about Seven o Clock in the same Evening one Edwards
Treadway called on this Deponent and informed him the said Isabella
Lyster had been called upon her Trial and for want of Evidence she
was acquitted or words to that or the like Effect And this Deponent
positively saith that he is very Sorry he did not attend to give his Evidence
against the said Isabella Lyster< no role > as it was his wish so to do And that he
