first this Deponent John Berry< no role >
for himself Saith that in
consequence of a Bill being preferred by the Grand Jury
against the above Defendant on Saturday last at the
Sessions house in the Old Bailey
in this prosecution he
this Deponent by the consent approbation and advice of
Mr Chetham the Sollicitors Agent in this Prosecution
caused a Notice to be served on Messrs Parnther and Druce
the said Sollicitors as also on the above named prosecutor purporting
that the above Defendant would Surrender and take his Trial on
the said Indictment on the then Tuesday following being theNineteenth
Twentyninth day of July Instant the said Mr. Chetham Observing
the Notice so to be given would be in Time And this Deponent
further Saith that on the said Defendants Appearing on the said
Twenty ninth day of July Instant agreeable to such Notice he
was informed the London Jury was discharged and that he
thereupon applied to the said Messrs. Parnther and Druces
for their consent for Application to this Honourable Court
for leave to Impannell or Summon a Jury upon this
Trial for Friday next or any Subsequent day the said
Court should Consider advisable to fix for that purpose
whereupon the said Mr. Druce Consented to this Deponents
Making such Application And this Deponent Saith
that the Reason for such his Application was in
Consequence of his being informed and which he verily believes
to be true that the above Deponents William Steel< no role >
