Indicted for Felony & Forgery.

Nicholas Querk< no role > a prisoner in the Custody of the Keeper of His Majesty< no role > 's Gaol
of Newgate for the City of London and Thomas Watkins< no role > of Little
Somerset Street near the Minories in the City of London Iron founder severally
make Oath and first the said Nicholas Querk< no role > for himself saith that John
Smith who lodged at a house known by the number 5. in Oxendon Street near
the Haymarket Westminster is a material witness for this Deponent on his
Trial on the Indictment against him at this present Session and that without the
benefit of the Testimony of the said John Smith< no role > for this Deponent on his said Trial
he this Deponent cannot with safety take his Trial on the said Indictment
And this Deponent saith that on or about the seventeenth Day of april last he
sent a Letter to the said John Smith< no role > to desire his Attendance as a Witness for
this Deponent during the present session and this Deponent on the eighteenth day
of the said Month received a Letter hereunto annexed from the said John Smith< no role > to acquaint this
Deponent that he the said John Smith< no role > was going to Newmarket but that he would
return in time to attend this Deponents said Trial at this present Session and
this Deponent saith that not having since heard from the said John Smith< no role > he
this Deponent caused a Wn't of Subpona to be taken out and a Copy thereof
to be made in order to be served on the said John Smith< no role > to appear as a Witness
for this Deponent outer's said Trial and this Deponent delivered such Subpona
and Copy to the other Deponent Thomas Watkins< no role > for the purpose
of sewing the same And this Deponent the said Thomas Watkins< no role >
for himself saith that at the Request of the said other Deponent he this Deponent
on Thursday and Saturday last went to the house of Mr. Fisher
known by the number 5 in Oxendon Street near the Haymarket Westminster
where this Deponent was informed and verily believes the said John Smith< no role >
lodged and was to be met with if he was returned from Newmarket And
this Deponent saith that on the said Thursday and Saturday last he
enquired for the said John Smith< no role > at the said House in order to serve him
