for Felony

William Gough< no role > of Holborn Hill London Live Poulterer,
Jonathan Wilkins< no role > of Plumb Tree Court Shoe Lane , London
Constable and John Fairweather< no role > of White Lion Street in the
County of Middlesex , Mariner, severally make Oath and say,
And First the said William Gough< no role > for himself saith, that
on the Eleventh Day of June last past he was bound by
Recognizance, before Henry Kitchin< no role > Esquire , one of his
Majesty's Justices of the Peace for the City of London , to
appear and give Evidence at the General Quarter Sessions
of Oyer and Terminer, and Goal Delivery of Newgate,
now holding for the said City of London , against the above
named William Brook< no role > for Feloniously stealing a linen handkerchief
of the Value of Six Pences the property of the said John Fairweather< no role >
And this Deponent Further saith, that pursuant to such
Recognizance, he Yesterday Morning the Fourth Day of July
Instant, came from Warfield in Berkshire , and attended the
Grand Jury at the Old Bailey , who found true Bill against the
said William Brooks< no role > for the Felony aforesaid, and the same
was brought into Court Yesterday Afternoon And this
Deponent further saith, that the said William Brooks< no role > , was
to his great Surprise shortly afterwards called upon his Trial
and discharged for want of Evidence, although this Deponent
had been waiting, and was anxiously desireous of giving
Evidence against him, but being informed by a Person
belonging to this Court, that the Bill being so lately found,
it was very improbable the Trial would come on in two
or three hours at least, he went to his House on Holborn
Hill to Dinner, intending to return to the Old Bailey
immediately afterwards And this Deponent further saith,
that he accordingly did return to the Old Bailey , and
then Found, that the said William Brooks< no role > had been
discharged for want of Evidence against him And this
Deponent further saith that he did not absent himself
when the said William Brooks< no role > was called to his Trial
out of any Favour, Affection or Hope of Reward, but
