Brief For the Appellants

Sheweth

That by Virtue of an Order or pass Warrant under the Hands & Seals of St William
Stephenson< no role > Knt . and John Wilkes< no role > Esqr . two of his Majestys Justices of the peace for the City of London (one
whereof being of the Quorum) bearing date the 18th. day of December 1773. George Simkins< no role > & Hannah< no role > his Wife
were removed & Convey'd by the Church Wardens and overseers of the poor of the parish of Allhallows Barking
in the said City from and out of their said Parish of the parish of St. Mary at Hill as the place of their last legal
Settlement.

That the Inhabitants of the sd. parish of St. Mary at Hill conceiving themselves aggrieved by the sd.
Order of pass Warrant humbly Appeal against the same Etc.

This Order of Removal is grounded upon the following Examination of the pauper George
Simkins taken the 18th. day of Decer 1773. as follows

The Examination of George Simkins< no role > taken this 18th. Day of Decer 1773

This Examinant on his Oath Saith That he was an Inhabitant of the parish of Saint Mary
at Hill in the City of London and was rated and paid poors rate in that parish And this Examinant
hath not Obtained any Subsequent Settlement.

Appellants Case

In the Year 1772 the Pauper George Simkins< no role > resided in the parish of St. Mary at Hill as a Lodger in
the House of one George Twitchins< no role > a Bricklayer

In the Year 1771 some time in May a Rate was made by the parish of Saint Mary at Hill for the
Relief of the poor of the said parish at 9d. P week oneachthe said George Twitchins< no role > as a House keeper
& Inhabitant of the said parish and he was was so lated an Assessd. in the Rate Book of the said
parish

Between the time of making the Rate which was stay 1771 and the time it was Collected
in the Year 1772 the sd. George Twitchins< no role > became Insolvent & ranaway from his House in the said Parish
leaving the pauper and his family and other Lodgers Inhabiting therein

When the parish Officer came about to Collect the said Rate he found the sd George Twitchins< no role >
the House keeper and person Rated had deserted his House the sd. Officer then applied to the Pauper then a
Lodger in the House to pay and discharge the Rate then die for the sd House for the said George
Twitchins his Land lord and to Induce him so to do that the late Might not be lost told him that as
he paid it on Account of his Landlord he might deduct it out of his Rent or to that purpose upon wch
the Pauper paid the late for his Landlord and the parish officer gave him a Receipt to that purpose
as he apprehends but does not Recollect the words of the receipt

Upon this Transaction the Pauper now founds his right of Settlement in the parish of St. Mary
