Bricklayer the above named Defendant and Mathew
Ballard< no role > of the same parish Waterman Severally
Make Oath And Say and first this Deponent John
Fraiser for himself Saith that he was bound by
Recognizance to Appear at the Guildhall London May
Session last to Try the above Indictment and did
Accordingly on the Eighth day of May last Attend this
Honble Court with his Witness's for the purpose of
trying his Traverse on the said Indictment but the
Prosecution being called did not Appear to Prosecute
the said Indictment whereupon the Court did not for
the reason aforesaid then proceed to Try the said
Indictment but putt off till the then next andrew
last June Session And this Deponent Mathew
Ballard for himself Saith that Notwithstanding
the said Elizabeth Siddall< no role > the Prosecutor did not
appear when called on the said Eight day of May
last to Provide the said Indictment he this
deponent then saw the said Prosecutrix in the
Guild Hall of the said City of London And this
Deponent John Fraizer for himself Saith That
on the Twenty Sixth day of June last he this Depont.
did Neglect to Attend this Honble Court in Order to
take his Tryal on the said Indictment this Deponst.
being Obliged to Attend on Particular business in the
may of this Deponents Trade whereby this Depont.
