the Defendant Maketh Oath that Charles Swallow< no role >
is a Material Witness for this Deponent on his Tryal of the Indictment
depending against him in the above Prosecution & for want of his
& believes to be true Safely proceed to the Tryal thereof And this
Deponents Saith that upon his enquiring after the said Charles
Swallow
for upwards of Ten Days last past in Order to Subpona
Particular Yesterday at his Lodgings in Frogmorton Street in the
City of London
in hopes to have had him served with a Subpona to
unable this Deponent to have had the said Indictment Tryed
this Sessions, when this Deponent was informed by a Relation of
Mrs. Coleburn in Frogmarton Street
[..] aforesaid where the
said Charles Swallow Lodges that he was not [..] in Town, and
was Gone to See his Father in Yorkshire
, & Cou'd not tell this
Deponent when he wo'd return, which Information this Deponent
believes to be true, And this Deponent saith that if the said
Charles Swallow< no role >
does not return to London before the next Sessions
of Oyer & Terminer to be held for the said City of London
, this
Deponent in such Case, will do his utmost endeavors to have him
Subpone'd to give his Evidence for this Deponent at this Deponent
further saith that he hath been credible informed this Day
Which information this Deponent believes to be true, That the said
Charles Swallow< no role >
will return to London again in about three
Weeks, or less, from this time.
