Appeal as he had promised but instead thereof put this Deponent off and
appointed to meet him at Joes Coffee House in Mitre Court being the Coffee
house he told this Deponent he used and this Deponent went thither
according to the said Appointment of the said Mr Hall and continued there
two Hours one before and one after the Appointed time but the said Mr.
Hall did not either come or send to this Deponent to his this Deponents
knowledge or belief Although this Deponent left Word at the Bar of the
said Coffee House that he waited for the said Mr. Hall And this Deponent
Saith that finding himself unable to get any Account of the state of the said
Appeal from the said Mr Hall and Suspecting by his behaviour that he
had been guilty of Neglect in Conducting the said Appeal this Deponent
applied to one Conversant as he heard in Session Business for Advice
what further Step to take on behalf of the Appellants when in the Month of
April last this Deponent was advised to Cause Search to be made at
the proper Office in order to know what proceedings there had been in the
said Appeal And thereupon this Deponent Caused such Search to be
made and found and was so informed by the said Mr. Chetham and believes
that the aforesaid Order of Adjournment of the said Appeal to the twelfth of
January last then was remaining in the Office drawn up and had not
ever been Called or sent for by the said Mr. Hall and that the said Mr. Hall
had not taken care to procure the said Appeal to be Adjourned at the last
January Session And that no further proceedings have been had or taken in
the said Appeal nor the same prosecuted or taken any Care of by the said
Mr. Hall from or after the then and now last January Quarter Session.
