The King against Richard Aaron< no role > Indicted for Receiving Goods
knowing them to be Stoln the Property of Philip Alloway< no role >

Philip Alloway< no role > of Christ Church in Surry Shipwright the Prosecutor
of the above Indictment and John Penn< no role > of the same Place Peruke maker
Jointly and Severally make oath as follows
And first this Depont. Alloway for himself Saith That Thomas Triplett< no role >
the Principal in the above Indictment was Convicted at the Sessions held
for the County of Surry on the thirteenth day of January last of Stealing a
Quantity of Goods in the sd. County of Surry the Property of this Depont.
and that the above Deft Richard Aaron< no role > is Indicted since for Receiving
the sd. Goods in the City of London knowing the same to be Stoln as aforesd.
And this Depont. Saith that MrHall an Attorney who was
Conserned in the Prosecution of the said Thomas Triplett< no role > in Surry
is now absent upon the western Circuit and hath gott the possession of
the Record of the said Conviction and will not Return to London 'till after the
Expiration of this present Sessions whereby this Depont. is Incapable of
Producing the sd. Record of the sd. Tripletts Conviction to this Honble Court
on this Present Tryal of the abovenamed Richard Aaron< no role > :

And this Depent. further Saith That John Draper< no role > of White Fryars London
Waterman is a Material Witness for this Depont. upon the Tryal of this Indictmt.
and without whose Testimony this Depont. cannot Safely Proceed to the
Tryal thereof & is now absent so that this Depont. cannot come at him to Subpena him:
And both these Deponts. Alloway and Pena Say that both these Deponts.
have for a Month Past used their utmost Endeavours to Come at the sd. John Draper< no role >
So as to Subpena him to give Evidence on the Tryal of this Cause, but have not
been able so to do and have for that Purpose left a Subpena for him at his
Father's house in White Fryars aforesd. [..]

But the Father of the said John Draper< no role > Informed these Deponts. that
the sd. John Draper< no role > his Son was at Portsmouth and that if he was in London
he shod. not appear agt. the sd. Deft the sd. Richard Aaron< no role > , or to that Effect.
